Orange Walrus is an event discovery platform that aggregates event information and allows community contributions to help people discover events.

3. User Accounts

You can use Orange Walrus without creating an account. Creating an account is optional but required for certain features.

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account.

You must provide accurate information when creating an account. You may not create accounts for fraudulent purposes or impersonate others.

4. Event Submissions and User Content

Users may submit event information to Orange Walrus. All submissions become part of our public event database and may be viewed by other users.

You represent that you have the right to submit any information you provide and that your submissions do not violate any third-party rights or applicable laws. You are responsible for the accuracy of information you submit.

We reserve the right to edit, modify, or remove any submitted content at our discretion, including to correct errors, remove duplicates, or maintain quality standards.

5. License Grant

By submitting event information or other content to Orange Walrus, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your submissions in connection with operating, providing, improving, and promoting our services.

6. Ownership and Intellectual Property

Orange Walrus owns the aggregated event database and our unique presentation and curation of event information. We own all intellectual property rights in the Orange Walrus platform, including our software, design, branding, and compilation of data.

Submitting content does not give you ownership rights in any Orange Walrus listings, database, or presentation. Orange Walrus owns the site, software, and the compilation, selection, and arrangement of listings, even if you submitted some of that information.

Users do not acquire any ownership rights in event listings on Orange Walrus. You cannot claim ownership of any listing or demand removal of accurate event information except through our standard event reporting process.

7. Event Listings

Event listings on Orange Walrus may be edited, combined with information from other sources, or removed at our discretion. We do not guarantee the accuracy or completeness of event information, and you should verify details with the venue or organizer before attending. If you believe an event listing is inaccurate or should be removed, you may report it for review.

8. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Submitting false, misleading, or fraudulent event information
• Spamming or flooding our platform with excessive submissions
• Impersonating another person or misrepresenting your affiliation
• Scraping, harvesting, or collecting data from Orange Walrus using automated means
• Attempting to gain unauthorized access to our systems or other users' accounts
• Infringing on intellectual property rights of others

9. DMCA and Copyright Policy

We respect the intellectual property rights of others. If you believe that content on Orange Walrus infringes your copyright, please contact us at hello@orangewalrus.com with detailed information about the alleged infringement.

10. Third-Party Services

Orange Walrus uses third-party services for things like hosting, analytics, maps, and authentication.

We make no warranties regarding the accuracy, reliability, or completeness of event information. We are not responsible for events being cancelled, rescheduled, or different from their listings.

12. Limitation of Liability

To the maximum extent permitted by law, Orange Walrus and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability to you for any claims arising from your use of Orange Walrus shall not exceed the fees you paid to us in the twelve (12) months before the claim arose.

13. Indemnification

You agree to indemnify and hold harmless Orange Walrus and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our services, your submissions, or your violation of these terms.

14. Termination

We reserve the right to suspend or terminate your access to Orange Walrus at any time, for any reason, including for violation of these terms. You may stop using our services at any time.

Upon termination, your right to use Orange Walrus will immediately cease. Provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of Orange Walrus shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

16. Changes to Terms

We may modify these Terms of Service at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of Orange Walrus after changes are posted constitutes your acceptance of the modified terms.
